Participant Acknowledgement and Waiver

Please read carefully before completing your booking.

This Participant Acknowledgement and Waiver (“Waiver”) is entered into between you (“the Participant”) and TouringCork, operated by Patrick Murphy, Cork, Ireland (CRO: 786146). By ticking the acknowledgement box at checkout, you confirm that you have read, understood, and agreed to this Waiver on behalf of yourself and any members of your party, including minors for whom you are the responsible adult.

1. Nature of the Activity

TouringCork operates outdoor guided walking tours in Cork city centre. Tours cover approximately 2-3 kilometres of public streets, footpaths, and open spaces over a period of 75-90 minutes. The route may include sections of uneven, cobbled, or sloped surfaces.

Participation in an outdoor walking tour involves inherent physical risks, including but not limited to:

  • Slips, trips, or falls on uneven or wet surfaces
  • Injury arising from contact with street furniture, vehicles, or other members of the public
  • Physical exertion, including fatigue or discomfort over the duration of the tour
  • Exposure to outdoor weather conditions
  • Unforeseen hazards on public streets

2. Acknowledgement of Risk

I acknowledge that participation in a TouringCork walking tour involves inherent physical risks. I confirm that I am in a suitable physical condition to participate, and that I have disclosed to TouringCork in advance any medical conditions, mobility limitations, or other factors that may affect my ability to participate safely.

You confirm that you:

  • Are in a suitable state of health and physical fitness to take part in a walking tour of the described nature and duration
  • Have informed TouringCork of any medical conditions, physical limitations, or accessibility requirements prior to booking
  • Accept that TouringCork cannot guarantee that the tour route will be free from all hazards at all times, as it takes place on public streets outside our direct control
  • Will follow all reasonable safety instructions given by the guide throughout the tour

3. Limitation of Liability

To the fullest extent permitted by Irish law, TouringCork, its operator, employees, and agents shall not be liable for:

  • Any personal injury, illness, or death arising from participation in a tour, except where caused by TouringCork’s own negligence
  • Loss, theft, or damage to personal property during a tour
  • Any indirect, consequential, or incidental loss or damage

Nothing in this Waiver excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded or limited under Irish law, including the Liability for Defective Products Act 1991 and the Consumer Protection Act 2007.

TouringCork holds public liability insurance. Where liability is established, our liability to you is limited to the amount paid by you for the relevant booking.

4. Health and Fitness Declaration

By completing your booking, you confirm that:

  • You do not have any medical condition, physical limitation, or impairment that would make participation in a 2–3 kilometre outdoor walking tour unsafe for you, or that you have disclosed any such condition to us prior to booking
  • You are not under the influence of alcohol or any substance that could impair your safety or the safety of others
  • If booking on behalf of others, you confirm that all members of your party are in a suitable condition to participate, or that any relevant conditions have been disclosed

5. Minors

Participants under 16 years of age must be accompanied by a responsible adult throughout the tour. By completing this booking on behalf of a minor, you confirm that you are their parent or legal guardian, or have the authority of such, and that you accept full responsibility for their conduct and safety during the tour.

6. Voluntary Participation

You confirm that your participation in a TouringCork tour is entirely voluntary. You understand the nature of the activity and the risks involved as described in this Waiver, and you choose to participate of your own free will.

7. Photography and Recording

You acknowledge that TouringCork may occasionally photograph or record tours for promotional purposes. If you do not wish to be included, please inform the guide at the start of the tour and we will take reasonable steps to accommodate your request.

8. Governing Law

This Waiver is governed by the laws of Ireland. Any dispute arising from this Waiver shall be subject to the exclusive jurisdiction of the Irish courts.

DIGITAL CHECKOUT CONFIRMATION

By ticking the box labelled “I have read and agree to the TouringCork Participant Waiver” at checkout, you confirm that:

  • You have read and understood this Waiver in full
  • You agree to its terms on behalf of yourself and all members of your party
  • You confirm the health and fitness declarations in Section 4
  • You accept that this constitutes a legally binding agreement under Irish law
